TERMS OF SERVICE
1. AGREEMENT ACCEPTENCE
These terms of service are directed to individuals, heads of families, or travel group organizers booking services with Boogalu Productions. It is the responsibility of individuals, heads of families, or travel group organizers to understand these terms of service and communicate and/or share these terms of service with the individuals in their travel group. All travel program individuals, heads of families, or travel group organizers will be deemed to have accepted this agreement and communicated and/or shared the terms of service to their group by signing below and/or paying the travel program deposit.
 
2. TRAVEL PROGRAM DEPOSIT & PAYMENT POLICY
A $100 - $300 USD non-refundable deposit, payable by check, cash, or credit card, is due at the time of booking services. Credit card payments may be subject to a surcharge fee. The payment schedule for the balance of services will be indicated in the travel plan-agreement.
 
3. CANCELLATION AND REFUND
Boogalu Productions reserves the right to cancel services or travel programs at any time prior to start date resulting from: natural disaster or adverse weather conditions, governmental actions, economic, or social instability, or any other events outside of Boogalu Productions control. In the event of such a cancellation by Boogalu Productions, the total amount paid to Boogalu Productions will be refunded including any deposit.

Any cancellations by participants or travel organizers must be by email. The date of cancelation will determine the clients refund amount.

If a participant or travel group cancels travel services, the non-refundable deposit can be applied to any other Boogalu Productions travel program in the next 12 months or transferred to other travelers of their choice.

If a participant or travel group for any reason cancels their travel services 31 days or more before the services start date, 100% of fees will be refunded minus the non-refundable deposit and any non-recoverable upfront costs incurred by Boogalu Productions on the travelers behalf.
Cancellations received within…

• 30 days of departure will receive 75% fee refund per person
• 15 days of departure will receive 50% fee refund per person
• 5 days of departure or during their trip will receive 0% refund per person

Comprehensive travel insurance is highly advised for participants wanting to guard against unforeseen cancellations as Boogalu Productions nor does accept responsibility for illness or accidents of any kind prior to or during travel.

4. CUBA COUNTRY CONDITIONS AND ACCOMMODATIONS
Participants should be aware that Cuba has particular features which may or may not appeal to you, including weather, food, water, local customs, etc. It’s living standards, practices and conditions with respect to the provision of utilities, services and accommodation at your destination are different. Such standards may not be comparable to those you would expect from similar establishments in Canada or the United States.
 
5. CHANGES TO ITINERARIES AND ACCOMMODATIONS
Boogalu Productions makes every attempt to insure accommodation reservations and itinerary activities are as planned. However, in circumstances beyond our control, changes may occur. We therefore reserve the right to change itinerary activities and substitute accommodations whenever necessary without notice.
 
6. PROGRAM SUPPLIERS
Boogalu Productions takes great care in selecting the suppliers of services (accommodations, transportation, teachers, and other professionals), which together form the travel program you have purchased. We act solely as agents for these suppliers which are independent parties over which we exercise no direct control. We shall not be liable for any claims, losses, damages, costs, expenses, delays or loss of enjoyment of any nature or kind whatsoever, to you or your traveling companions or group members, resulting from the acts, omissions or negligence of these suppliers.
 
7. RESPONSIBILITIES AND OBLIGATIONS OF PARTICIPANT
All program participants and travel groups are expected to obey the laws and regulations of Cuba and failure to do so will relieve Boogalu Productions of any and all obligations it may otherwise have to the offending tour participant or travel group. Boogalu Productions also reserves the right to exclude a participant or travel group from all or part of a program if the participant's or travel group’s conduct appears likely to endanger or impede the safe and comfortable progress of the travel program. In such case, the offending participant or travel group forfeits any claims against Boogalu Productions. Participants acknowledge that any loss of property, injury, accident, or health problems incurred during the program is not the responsibility of Boogalu Productions.
 
8. PERSONEL INFORMATION
Boogalu Productions guarantees that under no circumstances will it share your personal information with any agency, government, organization or private concern unless absolutely necessary or required by airlines, hotels, or transport companies. It is the responsibility of each participant to properly inform Boogalu Productions of any medical problems or special dietary requirements you may have.
 
9. MEDIA USE
Video or photos shot on the program by Boogalu Productions may be published for promotional purposes. If individual participants make it known they do not wish to have videos or photos taken or published of them, Boogalu Productions will not include them in the images.
 
10. AMENDMENTS OR CHANGES TO TRAVEL PLAN OR ITINERARY
If after accepting the travel program plan-itinerary, and the client, travel group, or the Boogalu Productions travel director want to make changes, both parties will have to agree on the changes and will then amend the document with their initials and date.
